Chapter 7: For Individuals and Couples

Chapter 7 is the most common form of personal bankruptcy, and often the fastest path to relief. It lets qualifying individuals with consumer and/or business debts wipe (discharge) most unsecured debt, including credit cards, medical bills, and personal loans, some tax debts and secured debts, for a genuine fresh start. Creditors can no longer pursue you for these debts. The vast majority of individuals do not lose any of their property at all, and are able to retain all of their property, including their home, vehicles, furniture, personal effects and retirement accounts. The process usually runs three to six months from filing to discharge.
